A notable trend over the last decade has been the rise of Employment Practices Liability ("EPL") claims. As of May, 2004 approximately 60% of all civil litigation in federal courts were EPL related. The Equal Employment Opportunity Commission ("EEOC") handled 79,432 claims in 2004. For the five-year period from 1997 to 2001 the EEOC recovered in excess of $1 billion for employees. This figure does not include attorney fees incurred.
Given these staggering numbers it is surprising that more businesses and companies do not carry EPL coverage. This significant exposure is readily insurable.
